Associate Legal Counsel

Position Summary:

The Associate Legal Counsel assists with legal operations for all the CyncHealth organizations. The role is responsible for day-to-day analysis, counsel and education on legal, policy, and contractual issues facing the company. This position will work across teams within CyncHealth, as well as with key organizations and clients.

Responsibilities include, but are not limited to the following:

  • Provide comprehensive general legal services including complex contract review, drafting and negotiating legal documents, including agreements with healthcare clients and partners, government contracts, procurement documents, proposals and other legal documents from clients, subcontractors, consultants, and vendors, including drafting BAAs, Data Use Agreements, and the like.
  • Develop and recommend company policy and positions on legal issues and relevant state and federal policy initiatives
  • Provide recommendations to ensure CyncHealth remains in compliance with relevant federal and state laws and regulations relating to health technology, data privacy, cybersecurity, and intellectual property rights.
  • As requested, interpret requirements for the business to comply with new or amended laws, regulations, and caselaw. Build successful relationships with colleagues and embedding awareness of legal risk management and corporate policy issues.
  • Exercise due diligence and implementing sound internal controls to minimize exposure to legal risks and ensure that CyncHealth and its entities operate legally and with integrity
  • Ensure that innovations developed in the organization are protected related to intellectual property management.
  • Understanding of the Governance model, policies articles of incorporation, and bylaws of the organization.
  • Be versed in the insurance, liability and coverage the organization has for offerings, services and technology.
  • Model CyncHealth’s values and Code of Conduct.
  • Other duties as assigned.

Experience/Requirements:

  • A Juris Doctor (JD) and a Nebraska state license in good standing to practice law.
  • At least 3 years’ experience in handling health information technology matters in a relevant regulatory agency, law firm, or healthcare organization is preferred. A combination of experience and education may fulfill the education and experience requirement.
  • Strong working knowledge of data privacy and health data legal matters.
  • Strong working knowledge of government and commercial contracting.
  • An understanding of healthcare-specific legal documents and requirements.
  • Healthcare experience in privacy, HIPAA, HITECH, TEFCA, interoperability, and data rights.
  • Strong attention to detail, with excellent written and verbal communication skills.
  • Strategic thinker and self-starter.
  • Ability to establish and meet deadlines in a fast-paced environment.

Physical Requirements:

  • Ability to work on a computer for extended periods of time.
  • Ability to stand or sit for extended periods of time.
  • Hours are generally Monday-Friday, 8:00 AM-5:00 PM. As operational deliverable deadlines emerge there may be extended working hours.
  • Light work requiring exertion up to 20 pounds of force occasionally, and/or up to 10 pounds of force frequently, and/or a negligible amount of force constantly to move objects.
  • Ability to work from La Vista, NE office with reliable and predictable attendance.
